Terms & Policies

The fine print, written as plainly as we can

Last updated: November 3, 2026. These policies apply to this website and to booking requests made through it for the vacation rental known as “Home on the River” in Ellijay, Georgia (“we,” “us,” “the host”).

Terms of Use

By accessing or using this website you agree to these Terms. If you do not agree, please do not use the site.

  • You must be at least 18 years old to submit a booking request, and the information you provide must be accurate and your own.
  • You agree not to misuse the site: no automated scraping, attempts to bypass security or rate limits, submission of false or abusive requests, or interference with other users.
  • All photos, text, logos and design on this site are owned by or licensed to us and may not be reproduced without written permission.
  • We may update the site, our rates, or these Terms at any time. Changes take effect when posted; the “Last updated” date shows the latest revision.

Booking & Stay Terms

  • Requests are not reservations. Submitting dates sends a request to the host. A booking exists only after the host confirms it by email.
  • Pricing. Quotes shown on the site are estimates based on current nightly rates and fees. The confirmed total in your confirmation email governs. Applicable taxes may be added.
  • Payment & check-in. The host will contact you with payment instructions and check-in details after confirming.
  • Occupancy. The maximum occupancy stated on the site may not be exceeded. Parties and events are not permitted without written approval.
  • River safety. The property is on a natural river. Water levels and currents change. Guests are responsible for their own safety and for supervising children and pets near the water and on decks and the hot tub.
  • Damage. Guests are responsible for damage beyond normal wear caused during their stay.
  • Bookings via Airbnb are governed by Airbnb's terms and the listing's policies, not this section.

Privacy Policy

What we collect. When you request a booking we collect your name, email, phone number, travel dates, guest count, whether you're bringing a pet, and any message you write. Our servers also process your IP address and basic technical data (browser type, pages requested) for security and rate limiting.

How we use it. To respond to and manage your booking request, communicate about your stay, prevent fraud and abuse, and meet legal obligations. We do not sell or rent your personal information, and we do not use it for third-party advertising.

Who we share it with. Only service providers that help us run the site (hosting, database and transactional email), bound to use it solely on our behalf, or authorities where legally required.

Retention. Booking records are kept for as long as needed to manage your stay and for our tax and legal records (generally up to 7 years), then deleted. Security logs are kept for a short period.

Security. We use HTTPS, strict input validation, rate limiting, and access controls to protect your data. No method of transmission is 100% secure, but we work to protect it.

Children. This site is not directed to children under 13 and we do not knowingly collect their information.

GDPR Rights (EEA/UK Visitors)

If you are in the European Economic Area or United Kingdom, we process your data on the legal bases of performing a contract (handling your booking request), legitimate interests (site security and abuse prevention), and legal obligation.

You have the right to access, correct, delete, restrict or object to processing of your personal data, to data portability, and to withdraw consent where processing is based on consent. You may also lodge a complaint with your local supervisory authority. Your data may be processed in the United States; we rely on appropriate safeguards for such transfers.

CCPA/CPRA Rights (California Residents)

California residents have the right to know what personal information we collect and how it is used, to request deletion or correction, and to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law, and we do not use sensitive personal information beyond what is needed to provide our services.

We will not discriminate against you for exercising these rights. You may use an authorized agent to submit a request; we may need to verify your identity before responding.

Cookie Policy

This site uses only strictly necessary cookies and storage. Guests browsing the site are not tracked with advertising or analytics cookies. A secure, HTTP-only session cookie is set only when the host signs in to manage bookings. Because we use no non-essential cookies, no cookie consent banner is required; if that ever changes, we will update this policy and ask for consent first.

Notice & Cure Policy

Before filing any claim or legal action relating to this website (including any claim regarding accessibility or privacy), you agree to first send us written notice describing the issue, the specific page or feature involved, and the remedy you seek. We will acknowledge your notice within 10 business days and will have 30 days from receipt to investigate and cure the issue. Where a fix reasonably requires longer, we will share a timeline. This policy does not limit any right that cannot be waived under applicable law.

Dispute Resolution

Informal resolution first. Most concerns can be resolved quickly by contacting us. Please follow the Notice & Cure Policy above before starting a formal proceeding.

Binding arbitration. Any dispute arising out of or relating to this website, these Terms, or a booking request that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Gilmer County, Georgia, or by video conference, unless otherwise agreed. Either party may bring an individual claim in small claims court instead, if it qualifies.

Class action waiver. You and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding.

Jury trial waiver. To the fullest extent permitted by law, you and we waive any right to a trial by jury.

Opt-out. You may opt out of arbitration within 30 days of first using the site or submitting a booking request by sending written notice to us. Opting out does not affect any other part of these Terms.

Governing law. These Terms are governed by the laws of the State of Georgia, USA, and the Federal Arbitration Act, without regard to conflict-of-law rules.

Disclaimers & Limitation of Liability

The website and its content are provided “as is” without warranties of any kind. Availability shown on the calendar is updated regularly but is not guaranteed until confirmed. Descriptions of local attractions are for convenience only; we do not operate or control third-party businesses or activities such as tubing, hiking or orchards.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the website, and our total liability relating to the website will not exceed the amount you paid us for the booking at issue. Nothing in these Terms limits liability that cannot be limited under applicable law.
